Yes this is legal because none of these recordings are official. In other words nothing here is owned by Columbia or Bruce. So yes it is perfectly legal.

I was gonna ask the same question. Not that i am in any way complaining, but it does seem strange. For instance bands like Phish, Allman Brothers, etc.. allow fans to tape shows as long as they are not sold. Bruce seems to have a strict no taping policy but yet these recordings keep surfacing. Again not that im complaining.

But if the band doesnt allow taping, and we (the fans) tape it anyway how is it not illegal?

Let me answer this question as plain as i can. If Bruce doesn't want tapers at his shows, all he has to do is amp up security. Plus he nor his record label have any copyright on these live recordings. Plus the recordings are NOT TO BE SOLD. If someone tries to sell these recordings, then that person is a money hungry JACKASS. So, IT IS NOT ILLEGAL. :?

I just thought of something terrible: What about the songs? Aren't they owned by Bruce?

They are, but through bootlegging he is neither making or losing any money off them. If he wanted to make money off the songs or any specific live cuts he could copyright and sell it himself. He owns the songs, but he doesn't own these recordings. Since most of these songs have been recorded on actual albums though, it would be illegal to try to pass the songs off as you're own.
